DewSoft Overseas hereby grants to User, a personal, non-transferable license to use the "Earn While You Learn Program"   in accordance with this Agreement and the Acceptable User Policy, which is incorporated herein as if fully set forth, and for no other purpose provided that you keep intact all copyright and other proprietary notices. All components of the "Earn While You Learn Program", including without limitation all Information/ Education/ Software/ Controls contained in it, is owned by DewSoft Overseas and/or its suppliers and is protected by copyright laws and international treaty provisions. Any reproduction or redistribution of the "Earn While You Learn Program"  is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible. 
Without limiting the foregoing, copying or reproduction of the software contained in the "Earn While You Learn Program"  to any other server or location for further reproduction or redistribution is expressly prohibited. The software is warranted, if at all, only according to the terms of this license and this agreement.

User shall prepay for the "Earn While You Learn Program". After receipt of the "Earn While You Learn Program", review it expeditiously because all fees are non-refundable and non-transferable after three (3) days from date of purchase. Sites removed for violation of this agreement, any related agreement or policy will not receive refunds. User's account balance is paid late, User will pay  $15 late charge should the payments are not received within 15 days from date of enrollment. It is required that should you realize that your payments might be late than 15 days, you email to the Sales Department, notifying the reason for delay, and mode/particular of payment, if you have already dispatched. For all your correspondence with  the company, please use your valid reference id number. User agrees to pay $20 fee for returned cheque charge and the Company's customary fee for other services such as transfer fees, etc. DewSoft Overseas  shall have the right to disconnect service for non-payment of billing charges. However, All rights pertaining to accepting late payments are held by the company. The Company on its sole discretion may accept or reject anyone's application for the program.

User must cancel this Agreement and request refund in writing at Dewsoft Office in India within three days of the date of activation of subscription package or receipt of money by the company, whichever is earlier. No refund is made for Application or processing fees, which stands as Rs.1500/- per application. Cancellation of the purchase of the "Earn While You Learn Program" will cancel all components of it.

Each User must keep any DewSoftNepal.com passwords and other secure accessible information confidential and notify DewSoftNepal.com promptly if User believes that the security of an account has been compromised. DewSoftNepal.com has taken reasonable steps to protect the security of online transactions. However, DewSoftNepal.com cannot and does not warrant such security and will not be liable for any losses or damages resulting from any security breaches.

DewSoftNepal.com cannot and does not screen all content provided on User sites and does not assume any obligation to monitor content. However, user agrees that DewSoftNepal.com may monitor sites and content periodically, and DewSoftNepal.com reserves the right at its sole discretion to remove any site, without notice and with no obligation to refund fees paid, which in its judgment is in violation of this agreement or otherwise is unlawful or harmful to DewSoftNepal.com and/or other users.

User can use web sites for business or non-business purposes. However, User may not post, transmit, or market the following: 

• Any material that is threatening, abusive, defamatory, obscene, or otherwise unlawful;

• Any material that violates the copyrights, trademarks, service marks, trade secrets, patents or other property rights of others;

• Any pornographic, sexually explicit or gambling material or links to similar adult content; 

• Any material that discloses personal private matters about any person without consent;

• Any material posted anonymously or under a false name.

• Any material which disparages DewSoftNepal.com, the "Earn While You Learn Program"  or other Users

Sites may not contain or transmit any file or software with a virus or other contaminating or destructive features. No User may in any manner interfere with the content of other sites or the system. Sites may not use excess system resources or otherwise, in DewSoftNepal.com's sole judgment, use resources in a manner that damages its system.

Materials included on web sites may include inaccuracies, errors, or out-and-out untruths. User agrees that DewSoftNepal.com has no liability or responsibility for any content, including the quality, accuracy, completeness, legality, or usefulness of any information, product, service or process promoted on other web sites or on User web sites. In no event shall DewSoftNepal.com be liable for any claims or damages of any kind arising from the contents of user's website and user hereby indemnifies and agrees to hold DewSoftNepal.com harmless therefrom. References in User's site to products, services, processes, hypertext links to third parties or other information by trade name, trademark, manufacturer, supplier or otherwise do not constitute or imply an endorsement or recommendation by DewSoftNepal.com . Product and service information is the sole responsibility of each individual site owner/user. User is solely responsible for compliance with laws governing the offering, Education Package Sale, licensing, or other marketing and taxation of any products. On occasion, DewSoftNepal.com will undergo routine maintenance or experience unexpected technical problems. DewSoftNepal.com will make a good-faith effort to do maintenance as quickly and conveniently as possible, and to respond to technical problems promptly. DewSoftNepal.com may be required to access User's web site from time to time to provide maintenance. DewSoftNepal.com will not in any circumstance be responsible for problems, losses, or damages arising from loss of connectivity; errors in content due to application problems; loss of access by User; or temporary or permanent loss of data.

User indemnifies and holds DewSoft Overseas / DewSoftNepal.com  harmless against all claims made by any third party, and any related damages and expenses (including reasonable attorney's fees), arising out of or connected with the user's conduct, the user's website or online store, the goods or services the user offers, or any violation of this agreement by  user.

DewSoftNepal.com Makes no warranties, express or implied, related to the "Earn While You Learn Program", products or services supplied thereunder or marketing materials sold, including but not limited to warranties of non infringement, merchant ability and fitness for a particular purpose.

DewSoftNepal.com will not be liable to any User for indirect, incidental, special or consequential damages, such as (but not limited to) loss of profits or business interruption, arising out of or connected to the use of, or inability to use, the "Earn While You Learn Program"  and included components and related services, products or marketing materials provided to any User. Parts of the "Earn While You Learn Program"  are obtained from third party suppliers. DewSoftNepal.com shall not be liable for, and User shall indemnify and hold DewSoftNepal.com harmless from, all liability arising from the failure of any such third party supplier to perform. Without limiting the applicability of the foregoing, the total liability of DewSoftNepal.com for any and all damages arising from or connected with this Agreement, the "Earn While You Learn Program"  or the services, products or marketing materials provided to any User shall not exceed the total fees paid by the User to DewSoftNepal.com during the 12-month period immediately preceding the initial occurrence of the event causing the damages.
